Do I need SR-22 insurance for a car I do not own?

If you were convicted of an offense and ordered to obtain an SR-22 but do not own your own vehicle, you will need non-owner SR-22 insurance coverage, also referred to as an SR-22 operator’s certificate.

An SR-22 is proof of your financial responsibility and insurance coverage. SR-22 insurance is an addition to any auto insurance policy, regardless of the type of policy you choose.

Always keep the SR-22 certification and auto policy documentation with you whenever you:

  • Operate any vehicle you do not own
  • Use a car rental service
  • Operate shared vehicles

What kind of SR-22 insurance do I need?

SR-22 is a certification of driver responsibility. An insurance provider files the correct SR-22 form with the Department of Public Safety (DPS). The certification proves to the state that their client has SR-22 insurance coverage.

The type of certificate a driver needs depends on their driving habits. The following options cover vehicle owners and non-owners:

Filing fees vary from state to state. Some states charge a filing fee as low as $12, others charge a flat fee of $35, or more. There is a separate fee to reinstate a suspended license which starts at $100 and goes up from there.

Additional costs depend on the cost of the auto insurance policy. The policy cost further depends on the amount and type of coverage you choose.

Additionally, private corporations tend to require full coverage insurance to lease or finance a vehicle. Car rental agencies vary depending on the company.

And yet, this does not mean a driver that needs SR-22 insurance is out of luck finding quality, affordable, and even downright cheap SR-22 auto insurance.

Take an annual liability premium, for instance, of $1,850, add an SR-22 filing fee and a license reinstatement fee. Your annual cost for insurance coverage could be as low as $1,962.

Although it is important to keep in mind, some insurance companies require up-front payment of the full annual premium. Other providers may offer monthly premiums. This does not guarantee the policy with monthly premiums will cost less than a policy paid up-front, in full.

What happens if I do not get SR-22 auto insurance?

There are many variables to consider when feeling tempted to ignore an SR-22 court order. The easiest way to avoid financial loss and further criminal offense is to buy SR-22 auto insurance.

First, an SR-22 is court-ordered following a conviction of a specific offense. A driver’s auto insurance provider must notify DPS when the driver first obtains SR-22 insurance coverage and promptly after coverage ends.

Subsequently, DPS and the state are made aware of court-order noncompliance. An insurance provider will report any of the following policy changes to DPS:

  • The policyholder cancels their auto policy
  • The policyholder allows their policy to lapse
  • The provider terminates the policyholder’s policy due to a high-risk level following a conviction or offense that requires an SR-22 certificate
  • The provider terminates the policyholder’s policy for additional traffic violations, accidents, or incidents following an SR-22 certification

Many states only require a minimum amount of insurance coverage. For instance, the Texas Department of Public Safety (TXDPS) requires Texas drivers to have auto insurance while driving a vehicle of any class.

In the state of Texas, liability insurance provides the minimum insurance coverage required. Liability insurance covers:

  • $25,000 – damage or destruction of property of others, one crash
  • $30,000 – bodily injury or death of one person, one crash
  • $60,000 – bodily injury or death of two or more persons in one crash

Additional fines, license suspension or revocation, and jail sentences are all possibilities if DPS determines a driver is in noncompliance with an SR22 court order.
